Database Licences

Athens account holders must comply with the licence conditions for each Athens resource. Library and Information Services licenses its databases from a range of suppliers. These licences have various restrictions. The main guiding principle is that they are for educational use only. This means that any use for commercial purposes is strictly forbidden. It is usually possible to access the licence conditions on the web site of the publisher. If you are in any doubt, you should consult the licence conditions. Many of the databases are purchased through consortial organisations, such as CHEST, JISC and NESLI. Some example information is provided below and links to web sites.

CHEST

The full CHEST agreement: http://www.eduserv.org.uk/chest/agreements/.

The CHEST agreement includes: Cambridge Scientific Abstracts Internet Database Service; Crossfire Beilstein & Gmelin; EBSCO databases; Emerald Fulltext; Web of Knowledge; Newsbank.

Location and Use Permissions

"Authorised Users" are those individuals who are authorised by the Licensee to access the Licensee's information services available through the Licensee's Secure Network and who are (i) affiliated with the Licensee as a current student, faculty, employee, or in some other capacity whereby they are permitted to access such services in the Licensee's ordinary course of business, whether from a computer or terminal on the Licensee's Secure Network, or offsite via a modem link to a valid IP address on the Licensee's Secure Network; (ii) additionally, in the case of walk-in users, they must be physically present on the Licensee's premises;

For clarity, and in response to frequently asked questions, the following additional definitions are given. It remains a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other person authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

DISTANCE LEARNING:
Distance learning is any learning that takes place with the instructor and/or necessary materials geographically remote from the student. For example distance learning may occur by surface mail, video, interactive or cable TV, satellite broadcast, or any number of Internet technologies such as message boards, chat rooms, and desktop video or computer conferencing. The student may be either normally UK domiciled or permanently domiciled overseas.

Students studying via Distance Learning can be categorised as:

1. UK domiciled, UK Based, i.e. all Students resident and studying within the UK.

2. Non-UK domiciled, UK based, i.e. a Student with an overseas home address but studying within the UK.

3. UK domiciled, non-UK based, i.e. British nationals on business or studying abroad.

4. Non UK-domiciled, non-UK based. i.e. Overseas home address studying abroad.

The licence for AccessUN permits such use.

REMOTE ACCESS within UK and EIRE:
Access to data service and content geographically remote from the licensed institution but within the boundaries of the UK and Eire.

The licence for AccessUN permits such use.

REMOTE ACCESS Overseas:
Access to data service and content via a licensed institution from outside the UK and Eire.

The licence for AccessUN permits such use.

STUDENT PLACEMENT IN INDUSTRY:
A registered student of an institution who combines academic study with periods of practical work experience. E.g. Sandwich Students.

Any use for the benefit of the students employer is specifically excluded.

PEOPLE FROM INDUSTRY ON COURSES RUN FOR THEIR EMPLOYER:
Industrial placement.

Such use is specifically excluded from licence for AccessUN.

RETIRED MEMBERS OF STAFF:
Former employees of a licensed institution.

Use rights terminate upon cessation of employment, except in the instance where the employee becomes a student.

HONORARY MEMBERS OF STAFF:
Persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution.

Such use would be permitted except where the user was doing so in pursuit of their non-academic activity.

ALUMNI:
Graduates of an Institution.

Use should terminate upon graduation and not be permitted again unless the graduate again qualifies under the terms for employees and students.

WALK-IN USERS:
Public access and Library terminals.

Use by walk-in visitors or general public users is allowed on the Licensee's site but not remotely.

 

JISC

The JISC agreement includes: British Standards Online; Education Media Online; Technical Indexes Info4Education; Literature Online.

3. Permitted Uses

3.1 Summary
The resource is provided for educational purposes only. Publication, redistribution to persons other than Authorised Users and all commercial use is expressly prohibited. Products, unless there is a clear statement to the contrary, are only licensed for use by staff, students and other persons 'engaged in the normal business of the licensed institution'.

3.2 Categories and Location of Users
The CSA Core Cambridge Sciences Collection Sub-Licence Agreement PERMITS use by the following categories of users:

a) Distance Learning (Students, Faculty and Staff regardless of location)
Access is provided for students, faculty and staff of subscribing institutions through a secure network regardless of their location. This includes distance learners. Distance Learning may be defined as any learning that takes place where the teacher and or the teaching materials are geographically distanced from the student. This student may be either normally UK domiciled or permanently domiciled overseas.

b) Remote Access within the UK
Access to data service and content is provided for Authorised Users who may be geographically remote from the licensed institution but within the boundaries of the UK.

c) Remote Access Overseas
Access to data service and content via a licensed institution is provided for Authorised Users who may be from outside the UK.

d) Student Placement in Industry
Access is provided for a registered student of an institution who combines academic study with periods of practical work experience as a student placement in industry (e.g. sandwich students). Any use for the benefit of the students employer is specifically excluded.

e) Walk-in-Users
Use by walk-in visitors is permitted while they are on the library premises. Walk-In Users may not be given means to access the licensed work when they are not within the library premises.

f) Honorary Members of Staff
Access is provided for persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution, except where access was in pursuit of non-academic activity.

The agreement PROHIBITS use for the following categories of users:

a) People from Industry on Courses Run by their Employer

b) Retired Members of Staff

Use rights terminate upon cessation of employment, except in the instance where the employee becomes a student, or maintains a formal staff relationship with the subscribing institution.

c) Alumni
Graduates of an Institution. Access terminates upon graduation.

3.3 Permitted and Prohibited Uses for Authorised Users
Authorised Users MAY

a) Access and use the product for classroom instruction and related activities including handouts, presentations, research, and student assignments.

b) Use the product as part of a professional presentation at a conference, seminar, workshop, or other professional activity or in a public display or performance in the (Institution name) gallery or similar facility.

c) Use the product for student or faculty portfolios, term papers, theses, and dissertations, provided copies of these are not published or redistributed.

Authorised Users MAY NOT

a) Use the product for any purposes other than education, research, or scholarship.

b) Use the product for any commercial or business-related purpose whatsoever.

c) Reproduce, distribute, redistribute, or publish the product outside of your institution without obtaining permission.

 

NESLI

The Model NESLi2 Licence for Journals 

The Model NESLi2 Licence for Journals is the model licence used by JISC staff or its agents in negotiations with publishers for JISC journal agreements. It is based on the Model NESLI Site Licence used by the NESLI Managing Agent in negotiations with publishers for NESLI agreements (which was in turn based on the PA/JISC draft model licence) and was approved by the JISC's NESLI Steering Group in 1999 for use by the NESLI Managing Agent.

The Model NESLi2 Licence for Journals takes into account that Content Complete Limited has been appointed as the negotiation agent for NESLi2.
