Shared Parental Leave
Shared Parental Leave (SPL) enables you to have more flexibility in considering how to best care for, and bond with, your child. All eligible staff have a right to take Shared Parental Leave. The following FAQ's explain if you are eligible and how much leave you and your partner can take if you wish to share the care of your child during the first year of their birth or adoption.
Shared Parental Leave FAQ's
Am I eligible to take shared parental leave?
To qualify for SPL, you must share responsibility for the child with one of the following:
- your husband, wife, civil partner or joint adopter
- the child’s other parent
- your partner (if they live with you and the child)
You or your partner must be eligible for maternity pay or leave, adoption pay or leave or Maternity Allowance.
You must also:
- have been employed continuously by the same employer for at least 26 weeks by the end of the 15th week before the due date (or by the date you’re matched with your adopted child)
- stay with the same employer while you take SPL
During the 66 weeks before the week the baby’s due (or the week you’re matched with your adopted child) your partner must:
- have been working for at least 26 weeks (they don’t need to be in a row)
- have earned at least £390 in total in 13 of the 66 weeks (add up the highest paying weeks, they don’t need to be in a row)
This can be as an employee, worker or self-employed person. Your partner doesn’t have to be working at the date of birth or when you start SPL or ShPP.
What leave am I entitled to?
If you’re eligible and you or your partner end maternity or adoption leave early, then you can take the rest of the 52 weeks of maternity or adoption leave as Shared Parental Leave (SPL)
What pay am I entitled to?
If you’re eligible and you or your partner end maternity or adoption pay (or Maternity Allowance) early, then you can take the rest of the 39 weeks of maternity or adoption pay (or Maternity Allowance) as Statutory Shared Parental Pay (ShPP)
ShPP is paid at the rate of £139.58 a week or 90% of your average weekly earnings, whichever is lower.
How do I apply for Shared Parental leave?
You need to give at least 8 weeks notice that you wish to take SPL, you should do this using the University’s SPL application forms.
How many blocks of Shared Parental leave am I entitled to?
You are entitled to request up to three blocks of parental leave on three separate requests.
What is discontinuous leave?
If one of your requests refers to more than one period of leave, e.g. if you request to work alternate weeks over a three month period this would be classified as a discontinuous leave request and does not have to be agreed by the University.
How does SPL relate to Paternity/Parental Leave?
If you are the partner and are entitled to two weeks paternity/partner leave (to be taken in the first 8 weeks) you are encouraged to use this before taking shared parental leave. If you do not do so you will lose any untaken leave entitlement.
